Achmea’s Aftermath: Jurisdictional Objections, Enforcement Actions, and the Fate of Intra-EU BITs

Overview

In the wake of the Court of Justice of the European Union’s Achmea decision against investor-state arbitration provisions in BITs between EU Member States, the European Commission, the Member States themselves, investor-state tribunals constituted under intra-EU BITs and the ECT, and parties seeking or resisting enforcement of awards from such cases are all wrestling with Achmea’s impact.

An expert panel will assess the state of play in each of those fora and consider what’s likely to come next.

The panel discussion will be followed by a reception.
